General and specific terms and conditions of sale

Definitions

This course is sold by Ian Huyton, acting under the trading name “White Marmotte”

The course is sold on either a full-package or a course-only basis.

The full-package is a holiday package including half-board accommodation and airport transfers as well as the course.

The course-only option is not a holiday package. It includes guiding and instruction, plus the costs of any public transport or uplift used as part of the course.

Résumé

The full-package price of the course is €1099 per person based on two people sharing a room. The price for one person having a room to themself is €1299.

The course is also available on a course-only basis. The price of the course-only option is €400 per person. The course-only option is outside the scope of French and European package travel regulations as it is not sold as a package.

To reserve a place on the course, a deposit must be paid to White Marmotte. The amount of the deposit is €80 per person for the course-only option and €220 per person for the full-package option. The remainder of the price must be paid no later than eight weeks before the start of the trip. If the balance payment is not received by this date, we reserve the right to cancel the booked services or resell the place to another customer. In this case your deposit will not be refunded.

Payments may be made by bank transfer or by any means of electronic payment we choose to offer on our website or via email. We prefer payments to be made by credit or debit card using our online payment gateway.

Course requirements

This is a moderately demanding hiking course at altitudes up to 2500 metres above sea level. Daily hikes can be up to around 15 kilometres with up to 1300 metres of ascent. The footpaths are rocky, steep and uneven in places. It is your responsibility to ensure you have the necessary fitness level and hiking ability.

Due to the demanding nature of the course, we ask that participants are at least 16 years of age, and are accompanied by a responsible adult if under 18.

Risques

Trekking in the Alps is a potentially dangerous activity with a risk of serious injury or death. Participants in White Marmotte courses must be aware of and accept these risks, and must take responsibility for their own actions during the trip.

Ian Huyton est un tour opérateur enregistré en auprès d'Atout France sous le numéro d'immatriculation IM038220006 conformément à l'article R. 211-21 du Code du Tourisme.

All funds paid to Ian Huyton / White Marmotte for package holidays (including courses sold as a package including accommodation) are protected by a financial guarantee provided by Groupama Assurance-Credit & Caution under contract number 4000717935/0 conforming to articles R.211-26 and R.211-29 of the French Code du Tourisme. Course-only bookings are not protected by this financial guarantee.

White Marmotte / Ian Huyton est couvert par une assurance responsabilité civile fournie par VHF Assurance France sous le numéro de contrat FR11-RCE22P00010, jusqu'à un maximum de 20 000 000 € par an et 10 000 000 € par sinistre.

Modifications et annulations

You may cancel your booking by informing us by email, telephone or in writing as soon as you become aware that you would like to cancel. If you cancel more than eight weeks before the trip, you will forfeit your deposit – any other amounts already paid will be refunded to you. If you cancel less than eight weeks before the start of the trip we will not normally be able to offer a refund.

Vos responsabilités

This trip takes place in a potentially dangerous Alpine mountain environment at altitudes up to around 2500 metres above sea level. To ensure the safety of yourself and of the group, we expect you to adhere to the following:

• Lisez attentivement la check-list fournie et assurez-vous d'apporter tout le matériel et les vêtements nécessaires.
• Assurez-vous que votre condition physique est suffisante pour le séjour que vous avez réservé.
• Veuillez suivre toutes les instructions données par le guide/accompagnateur
• Ne vous comportez pas d'une manière qui présente un danger pour vous-même ou pour les autres.

We reserve the right to refuse to continue guiding you if not follow the above requirements. Dans ce cas, vous n'aurez droit à aucun remboursement.

If you are unable to continue with the holiday due to illness or injury, we will assist you to access medical care and/or to return to your home. In this case we shall not be liable for any additional transport or accommodation costs, and in particular we will not be liable for repatriation costs. You will not be entitled to a refund for parts of the holiday you miss. Your travel insurance may cover costs in this instance. If mountain rescue is required, your insurance will be expected to cover any costs incurred.

If you choose to leave a hike before the end we cannot be held responsible for your safety and we will accept no liability for any adverse consequences.

You are responsible for your own possessions during the holiday, including but not limited to mobile devices, cameras, documents, bank cards, personal money and any other valuable items.

Notre service

Le service proposé par White Marmotte comprend les prestations suivantes :

• Five days of guiding and instruction by a qualified International Mountain Leader holding a UIMLA certified qualification.

The full package option also includes the following additional items:

• Private group return transfer between Geneva Airport and the hotel in the Chamonix Valley.
• Six nights hotel accommodation in the Chamonix valley (minimum standard 2-star).
• Six days breakfast.
• Six days evening meal.
• Tous les trajets en bus locaux, téléphériques ou autres services de transport jugés nécessaires par l'organisateur du séjour. Les voyages optionnels ne sont pas inclus, et il n'y aura pas de remboursement si ces services de transport ne sont pas utilisés.

The itinerary will follow that described on the White Marmotte website “www.whitemarmotte.com” and in the pre-course information. We reserve the right to make minor changes to the itinerary due to operational or safety reasons.

Le guide/accompagnateur est responsable de la sécurité et du bien-être du groupe à tout moment. Il a le droit de modifier l'itinéraire à tout moment ou de prendre toute autre mesure nécessaire pour assurer la sécurité, et sera pleinement soutenu par White Marmotte dans ce cas.

Droits à l'image

Sauf indication contraire de votre part, nous supposerons que toute photographie prise pendant le séjour mettant en scène des clients adultes peut être utilisée par White Marmotte à des fins promotionnelles sur les sites Web, les médias sociaux et dans la presse écrite. Veuillez nous informer à l'avance si vous préférez que nous n'utilisions pas les images sur lesquelles vous apparaissez.

Nous n'utiliserons pas d'images de mineurs de moins de 18 ans sans le consentement explicite de leurs parents.

Data Protection

Personal data transmitted to White Marmotte will be held securely and used for the purposes of providing the trip you have booked. Such information will include your name, email address, telephone number, travel insurance details, emergency contact details and travel/flight details. It will also include any information you provide to us by email or on our booking forms.

All data held by White Marmotte will be kept in accordance with French and European data protection law. White Marmotte will never disclose your details to third parties except where necessary to process your booking (e.g. to make reservations with our suppliers) or as required by law.

Assurance

Notre assurance et l'assurance responsabilité civile professionnelle du guide/accompagnateur couvrent les frais de recherche et de sauvetage en cas d'accident causé par nos actions ou nos omissions. Elle couvrira aussi normalement les paiements d'indemnités/de responsabilité en cas de faute de notre part. Elle ne couvre pas les conséquences de vos actions ou comportements individuels, ni forcément les frais médicaux ou les frais de rapatriement de l'hôpital à votre domicile.

Pour cette raison, les clients qui réservent ce séjour doivent obligatoirement souscrire une assurance accident individuelle which covers alpine trekking up to 3000 metres. It must cover search and rescue, medical and repatriation costs in both France and Switzerland. If you do not have such a policy already, French residents can purchase a suitable policy at www.sport.lycea.fr.

Comme nous ne pouvons offrir aucun remboursement pour les séjours annulés moins de huit semaines avant la date de début, en raison des dépenses que nous devrons engager après ce délai, nous recommandons vivement à nos clients de souscrire une police d'assurance annulation pour les couvrir au cas où ils ne pourraient pas voyager pour quelque raison que ce soit.

Conditions médicales

You must let us know if you have any condition that could affect your safety or your ability to complete day hikes at altitudes of up to 2500m above sea level. We will be happy to discuss ways to enable you to participate if at all possible.

Although the planned itinerary doesn’t cross very remote terrain, any rescue will still need to be carried out by helicopter in most cases, which may involve a substantial wait in bad weather. For this reason, the trip might not be suitable if you have a condition that could lead to a life threatening emergency, e.g. severe allergies, severe diabetes, severe uncontrolled epilepsy etc. We may refuse your booking or ask for a letter from a physician before accepting it if you have a medical condition of this type.

Visas

This course takes place in France with possible excursions into Switzerland. It is up to you to ensure that you have the right to enter these countries as a visitor. In particular, non-EU residents must ensure that they comply with the 90-day rule that applies to the Schengen area. You are strongly advised to carry a passport or identity card on days where we cross a national border.

Litiges

En cas de litige avec White Marmotte, nous vous suggérons de nous contacter directement pour discuter de vos problèmes et nous permettre de vous proposer une solution. Si le litige ne peut être résolu à l'amiable, nous souscrivons à un service de médiation auprès de MCP Médiation. Vous pouvez les contacter aux coordonnées indiquées ci-dessous.

Toute réclamation ou tout litige contre White Marmotte tombera sous la juridiction de la loi française.

MÉDIATION DE LA CONSUMMATION

En cas de litige non résolu par une solution amiable et ayant fait l’objet d’une réclamation écrite adressée par le client consommateur à l’entreprise, vous pouvez soumettre le différend au médiateur de la consommation dont les coordonnées sont les suivantes :
